Desi Fresh Inc. ("Desi Fresh," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit or use our website, mobile application, grocery ordering and delivery services, customer support channels, promotions, and any other service that links to this Policy (collectively, the "Services").
Please read this Policy carefully. It applies to personal information handled by Desi Fresh in connection with the Services, whether collected online or through customer support, order fulfillment, or delivery interactions. It does not govern the independent privacy practices of third-party websites, social-login providers, payment providers, retailers, couriers, or other services that do not act on our instructions.
1. Scope and Eligibility
The Services are intended for customers in the United States. You must be at least 18 years old, or the age of legal majority where you live, to create an account or place an order. If you use the Services on behalf of another person or household, you are responsible for having authority to provide their information and delivery instructions.
This Policy does not apply to personal information handled in an employment or independent-contractor relationship, except where we specifically state otherwise. Additional notices may apply to a particular promotion, loyalty program, age-restricted product, or feature; if an additional notice conflicts with this Policy, the more specific notice controls for that activity.
2. Personal Information We Collect
The personal information we collect depends on how you interact with the Services and which features you use. We collect information from you, automatically from your browser or device, and from service providers and other third parties.
2.1 Information You Provide
Account and contact information. Your name, email address, mobile number, username, account credentials, profile information, and communication preferences.
Social-login information. If you sign in with Google, Facebook, or another supported provider, we may receive a provider user ID and information the provider is permitted to share, such as your name, email address, and profile photo. The provider controls its own data collection and permissions.
Order and transaction information. Products viewed, searched for, added to a cart, purchased, substituted, refunded, or returned; order history; delivery slot; coupon or promotion use; tips; wallet or store-credit balance; gift or referral activity; and related transaction records.
Delivery information. Delivery address, saved address labels, access instructions, gate or building details, preferred delivery location, recipient name and phone number, and communications about an active delivery. Please avoid placing unnecessary sensitive information in delivery notes.
Payment information. Payment-card or bank information is generally collected and processed by our payment providers. We may receive a payment token, payment method type, card expiration date, last four digits, billing address, transaction status, and fraud-prevention signals.
Customer support and communications. Messages, emails, chats, call details, reviews, survey responses, photos you submit (for example, to report a damaged item), and other information you provide when you contact us or interact with the Services.
Promotions, referrals, and loyalty features. Information you submit for sweepstakes, offers, surveys, rewards, referrals, or other programs. If you provide another person's information, such as for a gift or referral, please share it only with that person's permission.
Age or identity verification. If we offer age-restricted products or if verification is reasonably needed to prevent fraud, we may request date of birth or ask a service provider to verify a government-issued ID. We receive only the information reasonably necessary for the verification and transaction where practicable.
2.2 Information Collected Automatically
Device and network information. Internet Protocol address, device type, operating system, browser type, app version, language, mobile carrier, device identifiers, advertising identifiers, and general network information.
Usage information. Pages, screens, products, and features viewed; searches; clicks; cart activity; referring and exit pages; session dates and duration; interaction with messages or advertisements; and error, crash, and performance data.
Location information. We infer an approximate location from your IP address and delivery address. With your device permission, we may collect more precise device location to confirm service availability, suggest nearby stores, help you select a delivery address, or support delivery-related features. You can change location permissions in your device settings and can usually enter an address manually.
Cookies and similar technologies. We and our providers may use cookies, pixels, software development kits, local storage, session technologies, and similar tools to keep you signed in, remember preferences, maintain your cart, protect the Services, measure performance, understand usage, and support marketing as described in Section 7.
2.3 Information From Other Sources
Social-login and account providers, subject to your settings and their policies.
Payment processors, fraud-prevention vendors, identity-verification providers, and financial institutions.
Retailers, suppliers, couriers, and delivery providers involved in fulfilling or supporting an order.
Analytics, advertising, and campaign-attribution providers, which may provide device, campaign, or interaction information.
Other users, such as when someone sends you a gift, referral, or order, or lists you as the recipient.
3. How We Use Personal Information
We may use personal information to:
- Create, maintain, authenticate, and secure your account.
- Display available products, prices, stores, delivery areas, and delivery slots.
- Process payments, fulfill orders, coordinate substitutions and refunds, and deliver purchases.
- Send order confirmations, delivery updates, security notices, service announcements, and other transactional communications.
- Provide customer support and respond to questions, complaints, refund requests, and feedback.
- Remember preferences, maintain carts and saved addresses, recommend products, and personalize your experience within the Services.
- Operate promotions, coupons, referrals, wallet credits, rewards, surveys, and loyalty features.
- Measure use, troubleshoot errors, improve accessibility, analyze performance, and develop or improve products and features.
- Detect, investigate, and prevent fraud, account misuse, payment abuse, security incidents, unsafe activity, and violations of our terms or law.
- Send marketing communications and measure or improve marketing, subject to your choices and applicable law.
- Comply with legal, tax, accounting, food-safety, product-recall, regulatory, and recordkeeping obligations; respond to lawful requests; and establish, exercise, or defend legal claims.
- Carry out another purpose disclosed when information is collected or with your direction or consent.
4. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients:
- Retailers, suppliers, and fulfillment partners. To confirm availability, prepare an order, handle substitutions or returns, and complete fulfillment.
- Delivery providers. To deliver orders, communicate about delivery, verify completion, and address delivery issues. Delivery providers receive only information reasonably necessary for the delivery and related support.
- Service providers and processors. Companies that provide hosting, cloud storage, software, payment processing, fraud prevention, identity or age verification, mapping, customer support, communications, analytics, campaign attribution, marketing, professional services, and security on our behalf.
- Advertising and analytics partners. Where used, these partners may collect or receive device identifiers, internet or app activity, approximate location, and campaign information for measurement, attribution, analytics, or targeted advertising, subject to your choices and applicable law.
- Affiliates. Current or future entities under common ownership or control, for purposes consistent with this Policy.
- Legal and safety recipients. Government authorities, law enforcement, regulators, courts, opposing parties, professional advisers, or others when we believe disclosure is required or appropriate to comply with law, protect rights or safety, investigate wrongdoing, enforce agreements, or respond to an emergency.
- Business-transaction recipients. Potential or actual buyers, investors, lenders, advisers, and other parties involved in a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction, subject to appropriate confidentiality protections where required.
- Recipients you choose. Other people or services when you direct us to disclose information, intentionally use a sharing feature, or otherwise consent.
We may also use or disclose aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you. We maintain and use de-identified information without attempting to re-identify it, except as permitted by law to test whether our de-identification processes are effective.
5. Payment Processing
Payment card and bank account details are generally provided directly to payment providers like Stripe, not to Desi Fresh. Those providers process payment information under their own privacy notices and security obligations. Desi Fresh uses the resulting token, payment status, and limited payment details to complete transactions, issue refunds, reconcile accounts, and prevent fraud. Never send full payment-card numbers or security codes through ordinary email, chat, review, or delivery notes.
6. Sale, Sharing, Targeted Advertising, and Sensitive Information
Desi Fresh does not sell personal information in exchange for money. We may allow analytics and advertising partners to collect identifiers, device information, internet or app activity, approximate location, and related campaign information through the Services. Under some state privacy laws, certain disclosures for cross-context behavioral advertising or other valuable consideration may be treated as a "sale," "sharing," or "targeted advertising" even when no money changes hands.
Where applicable, you may opt out through by contacting us as described in Section 16. Your opt-out applies to the browser, device, and identifiers we can reasonably associate with the request unless you provide additional information.
We do not knowingly sell or share the personal information of people under 16. We do not use sensitive personal information to infer characteristics about you. We use sensitive information, such as account credentials, precise device location, payment information, or identity-verification data, only as reasonably necessary to provide requested services, maintain security, prevent fraud, comply with law, or for another purpose permitted by applicable law.
We do not use personal information to make decisions that produce legal or similarly significant effects concerning access to employment, housing, credit, education, insurance, or essential services.
7. Cookies and Similar Technologies
We may use the following types of technologies:
- Strictly necessary technologies. Support sign-in, security, fraud prevention, cart functionality, checkout, load balancing, and core operation of the Services.
- Preference technologies. Remember language, location, delivery address, display, and other choices.
- Analytics and performance technologies. Help us understand visits and interactions, identify errors, measure features, and improve performance.
- Advertising and attribution technologies. Where used, help measure campaigns, limit repeated advertisements, understand conversions, or personalize advertising on other services.
You can control cookies through browser settings and, where available, our privacy choices interface. Mobile operating systems may provide separate controls for advertising identifiers, tracking permissions, location, and notifications. Blocking necessary technologies may prevent portions of the Services from functioning.
Some browsers transmit a "Do Not Track" signal, but there is no uniform industry standard for that signal. We do not respond to legacy Do Not Track signals. Where required by applicable law, we process supported browser-based universal opt-out signals, such as Global Privacy Control, as requests to opt out of sale, sharing, or targeted advertising.
8. Communications and Your Choices
Email marketing. Use the unsubscribe link in a marketing email. We may still send non-marketing messages about your account, orders, security, or changes to the Services.
Text messages. Follow the instructions in a message, such as replying STOP to marketing texts. Message and data rates may apply. Opting out of marketing texts does not prevent non-marketing texts where permitted by law, although you may be able to manage some service notifications in account settings.
Push notifications. Disable or adjust push notifications through the app or your device settings.
Location permissions. Change precise-location access through your browser or device settings. You can generally enter a delivery address manually, but location-based features may not work.
Account information. Review or update certain account details, saved addresses, and preferences in your account settings. You may request account deletion through the app or by contacting us.
9. Data Retention
We retain each category of personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain your account, complete orders and refunds, preserve transaction and consent records, support product recalls, prevent fraud, resolve disputes, enforce agreements, and satisfy legal, tax, accounting, and regulatory requirements.
Retention periods vary based on the type of information and context. We consider the duration of our relationship with you; whether the information remains needed for the purpose collected; the sensitivity and volume of the information; security and fraud risks; contractual commitments; applicable statutes of limitation; and legal retention duties. When information is no longer needed, we delete, de-identify, or securely dispose of it, subject to backup cycles and legal exceptions.
10. Data Security
We use administrative, technical, and physical safeguards designed to protect personal information, taking into account the nature and volume of information and the risks involved. These measures may include access controls, encryption in transit, monitoring, vendor review, secure development practices, and incident-response procedures.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your sign-in information, using unique credentials, and notifying us promptly if you suspect unauthorized use of your account.
11. U.S. State Privacy Rights
Depending on where you live and subject to legal exceptions, you may have the right to:
Confirm whether we process your personal information and access that information.
Correct inaccurate personal information
Delete personal information provided by or obtained about you.
Receive a copy of certain personal information in a portable format.
Opt out of sale, sharing, targeted advertising, or certain qualifying profiling.
Limit certain uses or disclosures of sensitive personal information, or withdraw consent where processing relies on consent.
Not receive unlawful discriminatory treatment for exercising a privacy right.
11.1 How to Submit a Request
Submit a request by emailing us support@desifreshgroceries.com with the subject line "Privacy Request." You do not need to create a new account to submit a request, although we may ask you to use an existing account when appropriate. Please identify the right you wish to exercise and the state where you reside.
We may take commercially reasonable steps to verify your identity and authority before completing a request, such as matching information you provide with account or transaction information. We will use verification information only for verification, security, fraud prevention, and legal compliance. We may deny or limit a request when permitted by law, including when we cannot verify it, an exception applies, the request would adversely affect another person's rights, or the request is manifestly unfounded, excessive, or repetitive.
You may use an authorized agent where permitted by law. We may require proof that the agent is authorized and may ask you to verify your identity or confirm the agent's authority directly. Opt-out requests may be submitted through legally recognized preference signals without identity verification when required by law.
11.2 Appeals
If we deny your request and your state provides an appeal right, you may appeal by replying to our decision or emailing support@desifreshgroceries.com with the subject line "Privacy Appeal." Include the request identifier and the reason for your appeal. We will respond within the period required by applicable law. If we deny an appeal from a New Jersey resident, we will provide a method to contact the New Jersey Division of Consumer Affairs to submit a complaint.
12. California Notice at Collection
This section supplements the rest of the Policy for California residents. Depending on the features you use, we may have collected the following categories of personal information during the preceding 12 months. The examples are illustrative, and we do not necessarily collect every example listed. Our sources, business purposes, and categories of recipients are described in Sections 2 through 4.
Desi Fresh does not sell personal information for money. As explained in Section 6, some analytics or advertising disclosures may be considered "sale" or "sharing" under California law. California residents may opt out of such activities where applicable and may exercise the rights described in this Policy.
13. Children's Privacy
The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, please contact us so that we can investigate and take appropriate action.
14. Third-Party Services and Links
The Services may contain links to third-party websites, applications, payment services, social-login providers, retailers, or other services. Those services operate under their own privacy policies and terms. Desi Fresh is not responsible for the privacy, security, or content practices of third parties that do not act on our instructions.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make changes, we will update the "Last updated" date above and, where required by law, provide additional notice. Your continued use of the Services after an updated Policy becomes effective means that you acknowledge the updated Policy.
