Welcome to Desi Fresh. These Terms & Conditions ("Terms") govern your access to and use of the Desi Fresh website, mobile applications, grocery ordering and delivery services, and related services (collectively, the "Services").
By accessing or using the Services, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or place an order through the Services.
By using the Services, you represent that you meet the applicable age requirement and have the legal capacity to enter into these Terms.
2. Account Registration
Certain features require you to create an account. You agree to provide accurate, complete, and current information and to keep your account information updated.

You must notify Desi Fresh promptly if you believe your account has been accessed without authorization.
3. Orders
Product listings, prices, availability, promotions, delivery areas, and delivery slots may change at any time.
Adding an item to your cart does not guarantee that the item will remain available or that the displayed price will remain unchanged until checkout.
An order is considered accepted only after Desi Fresh confirms the order. We may cancel or modify an order where permitted by law, including because of product availability, pricing errors, suspected fraud, delivery limitations, or other operational reasons.
4. Product Availability and Substitutions
Grocery products may become unavailable after an order is placed. Where substitutions are available, we may offer a similar product based on your preferences and applicable substitution settings.
You may be notified of substitutions and may have the opportunity to accept or reject them depending on the order and fulfillment process.
5. Pricing and Payment
Prices displayed through the Services may change without notice. The applicable price is generally the price shown at checkout, subject to applicable taxes, delivery fees, tips, substitutions, discounts, and other charges.
Payment may be processed by third-party payment providers. You authorize Desi Fresh and its payment providers to charge your selected payment method for the applicable order amount.
6. Delivery
Delivery availability depends on your location, operating hours, inventory, delivery capacity, weather, traffic, and other circumstances.
Delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.
You are responsible for providing an accurate delivery address and any reasonably necessary delivery instructions.
7. Cancellations, Returns and Refunds
Cancellation, return, replacement, and refund eligibility may vary by product, order status, and applicable law.
Certain perishable, temperature-sensitive, or otherwise restricted products may be subject to different return or refund rules.
If an item is missing, damaged, incorrect, spoiled, or otherwise does not meet applicable requirements, contact customer support as soon as reasonably possible.
8. Promotions and Referrals
Promotional codes, discounts, referral rewards, wallet credits, and other offers are subject to the terms communicated with the applicable promotion.
Promotions may have eligibility requirements, expiration dates, order minimums, product restrictions, geographic limitations, or other conditions.
Desi Fresh may cancel or refuse promotional benefits where it reasonably determines that an offer has been obtained through fraud, abuse, duplication, self-referral, or violation of applicable terms.
9. User Content
You may have opportunities to submit reviews, comments, photos, feedback, questions, or other content through the Services.
You are responsible for the content you submit and must not submit content that is unlawful, defamatory, misleading, abusive, infringing, fraudulent, or otherwise inappropriate.
By submitting content, you grant Desi Fresh a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute the content as reasonably necessary to operate, improve, and promote the Services, subject to applicable law and our Privacy Policy.
10. Prohibited Use
You may not use the Services to:
- Violate any applicable law or regulation.
- Impersonate another person or misrepresent your identity or affiliation.
- Access another user's account without permission.
- Interfere with or disrupt the Services or related systems.
- Introduce malware, malicious code, or other harmful material.
- Scrape, copy, reverse engineer, or systematically extract information from the Services except as expressly permitted.
- Attempt to bypass security, authentication, or access controls.
- Abuse promotions, referral programs, payment methods, refunds, or other features.
11. Intellectual Property
The Services and their contents, including text, graphics, logos, trademarks, images, software, designs, interfaces, and other materials, are owned by or licensed to Desi Fresh and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms or applicable law, you may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit the Services or their contents without prior written permission.
12. Third-Party Services
The Services may integrate with or contain links to third-party websites, applications, payment processors, social-login providers, retailers, delivery partners, analytics services, and other third-party services.
Third-party services are governed by their own terms and privacy policies. Desi Fresh is not responsible for third-party services that it does not control.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. Desi Fresh does not guarantee that the Services will always be uninterrupted, error-free, secure, or available at every location or time.
Product information, availability, prices, images, descriptions, nutritional information, and other information may contain errors or omissions. We may correct errors and update information at any time.
Desi Fresh does not guarantee that a product will meet every individual dietary, allergy, nutritional, or personal requirement. Customers are responsible for reviewing product information and labels and making appropriate decisions for their own needs.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Desi Fresh and its affiliates, officers, employees, agents, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Desi Fresh and its affiliates, officers, directors, employees, agents, suppliers, and service providers from claims, liabilities, damages, losses, and expenses arising from your misuse of the Services, violation of these Terms, violation of applicable law, or infringement of another person's rights.
16. Termination
We may suspend or terminate your access to the Services where permitted by law, including if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, created a security risk, or otherwise misused the Services.
You may stop using the Services at any time and may request deletion of your account subject to applicable legal and operational requirements.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we may provide additional notice where required by law. The updated Terms will become effective on the date stated in the updated Terms.
Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the changes to the extent permitted by law.

These Terms are governed by applicable laws without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
